PAIA Manual

Prepared in accordance with Section 51 of the Promotion of Access to Information Act, No. 2 of 2000.

1. Introduction

The Promotion of Access to Information Act, 2000 ("PAIA") gives third parties the right to approach private bodies and the government to request information held by them, which is required in the exercise and/or protection of any rights. On request, the private body or government is obliged to release such information unless the Act expressly states that the records containing such information may or must not be released.

This manual informs requesters of procedural and other requirements which a request must meet as prescribed by the Act.

3. Records Available Without Request

The following records are automatically available to the public and do not need to be requested formally in terms of the Act:

  • Information available on the MediGo Waste website.
  • Product and Service brochures.
  • Newsletters and marketing materials.
  • Standard Operating Procedures (SOPs) published for public view.

4. Records Available on Request

The following records are held by MediGo Waste and may be requested. Access to these records is not automatic and may be refused based on the grounds of refusal listed in the Act.

5. Request Procedure

To request access to a record, please follow these steps:

  1. Use the prescribed Form 2 (Request for Access to Record).
  2. Address the request to the Information Officer using the contact details in Section 2.
  3. Provide sufficient detail on the request form to enable the Information Officer to identify the record and the requester.
  4. Indicate which form of access is required and specify a postal address or fax number in South Africa.
  5. Identify the right that the requester is seeking to exercise or protect and explain why the requested record is required for the exercise or protection of that right.
  6. Pay the prescribed request fee (if applicable).

6. Fees

PAIA provides for two types of fees:

  • Request Fee: A standard non-refundable fee payable by requesters who are not personal requesters.
  • Access Fee: Calculated based on the time required to search for, prepare, and reproduce the record.
