1. Platform Nature

MediGo Waste ("the Platform", "we", "us", "our") is a technology platform that provides digital services for medical waste management. The Platform operates as an intermediary technology service provider and does not physically handle, transport, collect, treat, or dispose of medical waste.

By using this Platform, you acknowledge and agree that MediGo Waste is solely a technology intermediary providing software, digital tracking, and communication services to facilitate connections between waste generators and waste collection companies.

2. No Physical Waste Handling

MediGo Waste does not physically handle, transport, collect, treat, or dispose of any medical waste. The Platform does not own, operate, or control any waste collection vehicles, treatment facilities, or disposal sites.

All physical operations related to medical waste, including but not limited to collection, transportation, treatment, and disposal, are the sole responsibility of the waste collection companies and waste generators who use this Platform.

3. Generator Responsibilities

Waste generators (including but not limited to healthcare facilities, medical practices, skincare clinics, tattoo studios, and other entities generating medical waste) are solely responsible for:

  • Proper classification and categorization of medical waste according to applicable regulations and standards.
  • Safe packaging, labeling, and storage of medical waste in compliance with all applicable laws and regulations.
  • Maintaining all necessary licenses, permits, and registrations required for generating medical waste.
  • Compliance with all applicable local, provincial, and national laws, regulations, and standards governing medical waste management.
  • Ensuring accurate information is provided through the Platform regarding waste quantities, types, and classifications.

Note: MediGo Waste is not responsible for any errors, omissions, or misclassifications made by waste generators in their use of the Platform.

4. Waste Collection Company Responsibilities

Waste collection companies (including transporters, treatment facilities, and disposal operators) are solely responsible for:

  • Safe and compliant collection, transportation, and handling of medical waste.
  • Maintaining all necessary licenses, permits, insurance, and registrations required for waste collection, transportation, treatment, and disposal operations.
  • Compliance with all applicable transportation, safety, and environmental regulations during waste collection and transport.
  • Proper treatment and disposal of medical waste at licensed and compliant facilities.
  • Maintaining accurate records and documentation as required by law.
  • Ensuring all drivers and personnel are properly trained, licensed, and qualified for medical waste handling operations.

5. Limitation of Liability

To the maximum extent permitted by law, MediGo Waste, its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:

  • Physical handling, transportation, collection, treatment, or disposal of medical waste.
  • Accidents, spills, contamination, or environmental damage related to waste operations.
  • Non-compliance with laws, regulations, or standards by waste generators or collection companies.
  • Errors, omissions, or misrepresentations made by users of the Platform.
  • Service interruptions, technical failures, or unavailability of the Platform.

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied.

6. Service Availability

MediGo Waste provides technology services only, including but not limited to:

  • Digital platform and mobile application services.
  • Digital manifest and documentation services.
  • Order tracking and communication services.
  • Scheduling and coordination services.

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice. We do not guarantee uninterrupted or error-free operation of the Platform.

7. User Obligations

By using the Platform, you agree to:

  • Comply with all applicable local, provincial, and national laws and regulations governing medical waste management.
  • Provide accurate, complete, and truthful information when using the Platform.
  • Maintain all necessary licenses, permits, and registrations required for your operations.
  • Accept full responsibility for all physical waste handling operations.
  • Not hold MediGo Waste liable for any issues arising from physical waste handling.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or related to these Terms and Conditions or the use of the Platform shall be subject to the exclusive jurisdiction of the courts of South Africa.
